Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of Art6ix’s event discovery and publishing platform (the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.


2. The Service

Art6ix is a free, web-based platform that helps people publish and discover events, venues, artists, and organizers, save favourites, rate events, and export events to external calendar applications. The Service is provided at no cost to users. We do not guarantee the accuracy, completeness, timeliness, or availability of any listing, and we do not endorse, verify, or assume responsibility for any particular event, organizer, venue, artist, or any content posted by users.


3. Eligibility & Accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account or use the Service.
  • You may sign in using Google OAuth or email and password authentication. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information when creating your account and to update it as necessary.
  • Please notify us immediately at support@art6ix.ca of any unauthorized use or security incident involving your account.
  • We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for any reason.

4. User Content & Licenses

  • “User Content” means all content you submit, upload, or make available through the Service, including but not limited to event details, descriptions, images, profile information, ratings, and links.
  • You retain ownership of your User Content. By submitting User Content, you grant Art6ix a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, display, reproduce, modify, and distribute your User Content solely for operating, improving, and promoting the Service. This license continues for as long as your User Content remains on the Service and for a reasonable period after deletion to account for backups and caching.
  • You represent and warrant that you have all rights, permissions, and consents necessary to submit your User Content and to grant the license above, and that your User Content does not infringe or violate any third-party intellectual property, privacy, or other rights, or any applicable law.
  • Public submissions (events, profiles, venues, artists, and organizations marked as public) may be visible to anyone. Do not include confidential or sensitive personal information in public submissions.
  • Images uploaded to the Service must not exceed 5 MB per file. We reserve the right to remove or refuse any image or content that violates these Terms.

5. Event Listings & Accuracy

Art6ix serves as a platform for users to publish and discover event information. We do not organize, host, or operate any events listed on the Service. Event details, including dates, times, locations, descriptions, and ticket links, are provided entirely by the users or administrators who submit them. Art6ix makes no representations or warranties regarding the accuracy, completeness, legality, or reliability of any event listing. You acknowledge and agree that:

  • Your attendance at or participation in any event listed on the Service is entirely at your own risk.
  • Art6ix is not liable for any loss, injury, damage, or dispute arising from your attendance at, participation in, or reliance on any event or event information.
  • Ticket links point to external third-party vendors. Art6ix has no control over and assumes no responsibility for third-party ticketing services, refunds, or transactions.
  • Events may be cancelled, rescheduled, or changed without notice. Art6ix has no obligation to notify you of such changes.

6. No Payment Processing

The Service does not process, collect, or store any payment or financial information. The Service is provided entirely free of charge. Any ticket links included in event listings redirect to external third-party websites. Any transactions you complete through those external websites are solely between you and the third-party provider, and Art6ix bears no responsibility for those transactions.


7. Ratings & Reviews

The Service allows authenticated users to rate events on a 5-star scale. Ratings reflect individual user opinions and do not represent the views of Art6ix. We do not verify or endorse any rating. We reserve the right to remove ratings that violate these Terms.


8. Calendar Export

The Service allows you to export event details to Google Calendar or download .ics files for use with Apple Calendar, Outlook, or other calendar applications. Calendar export is provided as a convenience only. Art6ix is not responsible for any errors, omissions, or inaccuracies in exported event data, and any reliance on exported calendar data is at your own risk.


9. Map & Location Features

The Service includes an interactive map powered by Leaflet and OpenStreetMap. The “Locate Me” feature uses your browser’s geolocation API, which requires your permission. Map data and location accuracy are provided by third-party services, and Art6ix makes no guarantees about the accuracy or availability of map features.


10. Content Moderation & Administration

Art6ix administrators may review, edit, verify, or remove any User Content, including events, venues, organizations, and artist profiles, at their sole discretion and without prior notice. Events may be subject to a review process before publication. We are under no obligation to monitor or review User Content but reserve the right to do so. Content may also be discovered and imported using AI-powered tools; all such content is reviewed by an administrator before publication.


11. Prohibited Conduct

  • Posting unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable content.
  • Publishing events that encourage illegal activity or pose safety risks.
  • Submitting false, misleading, or fraudulent event information.
  • Uploading images or content that infringe third-party intellectual property or other rights.
  • Scraping, crawling, reverse engineering, or attempting to access the Service or its underlying systems without authorization.
  • Interfering with or disrupting the Service, servers, or networks, or deploying malware, spam, or automated tools.
  • Impersonating any person or entity, or misrepresenting your affiliation.
  • Using the Service for any commercial purpose not expressly authorized by Art6ix.
  • Circumventing or attempting to circumvent any security measures, access controls, or usage limits.

12. Third-Party Links & Services

The Service may contain links to or integrations with third-party websites and services, including but not limited to Google Calendar, external ticketing platforms, OpenStreetMap, and social media platforms. Art6ix does not control, endorse, or assume any responsibility for any third-party content, products, services, or practices. Your use of third-party services is subject to their respective terms and privacy policies. Art6ix is not liable for any loss or damage arising from your use of or reliance on any third-party service.


13. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Art6ix and its licensors. The Art6ix name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Art6ix. You must not use such marks without our prior written permission.


14. Changes, Suspension, and Termination

We may modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice, and without liability to you. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for Art6ix, or for any other reason at our sole discretion. You may stop using the Service and request account deletion at any time by contacting support@art6ix.ca.


15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ART6IX EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ART6IX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ART6IX DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, DATA, OR INFORMATION OBTAINED THROUGH THE SERVICE, INCLUDING EVENT LISTINGS, MAP DATA, RATINGS, USER CONTENT, OR AI-GENERATED CONTENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.


16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ART6IX, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, THESE TERMS, ANY USER CONTENT, ANY EVENT LISTED ON THE SERVICE, OR ANY THIRD-PARTY SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ART6IX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, ART6IX’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED TEN CANADIAN DOLLARS (CAD $10.00). THIS LIMITATION APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.


17. Indemnification

You agree to defend, indemnify, and hold harmless Art6ix and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of or inability to use the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party right, including intellectual property, privacy, or other rights; or (e) your attendance at, participation in, or reliance on any event listed on the Service.


18. Assumption of Risk

You acknowledge that the Service is an event discovery platform and that Art6ix does not organize, host, operate, or endorse any events listed. You assume all risk associated with attending, participating in, or relying on any event or event information found through the Service. Art6ix shall have no liability for any injury, loss, claim, damage, or expense of any kind arising from events listed on the Service.


19. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada, for any dispute arising out of these Terms or the Service. You waive any objection to venue or jurisdiction in such courts.


20. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.


21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Art6ix regarding the Service and supersede all prior or contemporaneous agreements, understandings, or representations.


22. Waiver

The failure of Art6ix to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by Art6ix.


23. Changes to Terms

We may update these Terms from time to time. The updated version will be posted with a new “Last updated” date. If changes are material, we will provide additional notice as required by law. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
